To celebrate our first year anniversary, we are holding our first annual Create A Kit Contest. Here are the rules for the contest.
TONOODLE CREATE A KIT OFFICIAL CONTEST RULES
- NO PURCHASE NECESSARY TO ENTER OR WIN.
- CONTEST DESCRIPTION
Submit a new, original digital scrapbook kit (“Kit”) created by you to win a year membership subscription to toNoodle.com and have your Kit as a featured download by toNoodle members.- Kit must be a new, original work created by you that has not been previously offered for sales or offered as a free download.
- Kit can have any theme and must have at least twelve (12) elements.
- Kit can include any or all of the following: papers, overlays, embellishments (ric rac, ribbon, flowers, frames, string, wire, doodles, charms, buttons, etc.) alphabets (alphas), word art, and quick pages.
- You CAN NOT use any action, brush, element, or any other item that is copyrighted by another company or individual UNLESS it has been specifically designated for royalty free commercial use and distribution. We are fine with you using commercial use content in your design, as long as all parties involved are legally able to redistribute the content without infringing on, or being financially liable for any infringement of copyright, ownership, or gainful sale of the item. Do not assume if there is no Terms of Use included in your files that commercial use is allowed. If there is any question, you should email the creator of the work and gain his/her approval in writing before you submit your work.
- Entrants can submit a high quality, 1000×1000 pixel preview through our Contest submission form. This preview must include your kit name and your name on the preview sample. - CONTEST DATES
- Entries may be submitted starting on January 16, 2009 at 12:00 a.m. Mountain Standard Time (“MST”) and ending on March 15, 2009 at 11:59 p.m. MST unless and until otherwise modified or terminated by toNoodle LLP. All entries must be received by 11:59 PM MST on March 15, 2009 to be eligible to win.
- Twenty (20) Finalists will be selected by the toNoodle Contest Committee by March 19, 2009 from those entries satisfying all submission criteria. The finalist entries will be posted on the toNoodle website for all visitors to vote on. The voting period will start March 20, 2009 at 12:00 a.m. MST and ending on March 31, 2009 at 11:59 p.m. MST.
- On or after April 1, 2009, One (1) First Place Winner, One (1) Second Place Winner and One (1) Third Place Winner (“Winners”) will be announced. The contest will be conducted by toNoodle whose decisions shall be final and binding in all matters pertaining to this promotion. All 3 Winners will be notified via email (or telephone if provided) within approximately five (5) business days from April 1, 2009.
- The winners will be announced on the toNoodle website on April 15, 2009.
- PRIZES
1st Place Prize: One year membership subscription to toNoodle.com valued at $300. 2nd Place Prize: Six (6) month membership subscription to toNoodle.com valued at $150. 3rd Place Prize: 3 Month subscription to toNoodle.com valued at $75. In addition, the digital scrapbook Kits submitted by each winner will be featured as an exclusive download to all members of toNoodle.com. Odds of winning depend upon the number of entries received. - HOW TO ENTER
All entries must be uploaded using the Contest submission form during the contest period. No mail-in entries will be considered. Entrants should submit a high quality, 1000×1000 pixel preview through our Contest submission form. This preview must include your kit name and your name on the preview sample. Also required on the submission form is your name, email address, and Kit title. Telephone number is not required but may be provided as an alternate means to contact entrant. - WHO MAY ENTER
Contest is open to residents of the 50 United States of America and the District of Columbia only. Contest is subject to all applicable laws and void where prohibited by law. - ELIGIBILITY
Entrants must be 18 years of age or older at the time of entry. Employees of toNoodle LLP, its parents, subsidiaries, affiliates, suppliers, manufacturers, or their immediate families are not eligible. Design team members who provide content for affiliates of toNoodle LLP may enter the contest only if they are deemed “independent contractors” by law for whom they design. - JUDGING
Judging will be based on, but not limited to the following criteria:- Design elements (color, repetition, balance etc.).
- Originality and innovation.
- Variety of pages and page elements.

Winners will be listed on the toNoodle.com website April 15, 2009. To receive a list of winners, send a self addressed stamped envelope, together with a note indicating Contest of interest to: toNoodle LLP, 540 E 500 N, American Fork, UT 84003. - TERMS AND CONDITIONS
By submitting a Kit to this contest, you agree to the following Terms and Conditions.- All elements within each Kit must be an original work saved in a digital format. Original photographs, textures, drawings, paintings or other works of art are allowed as long as they are converted to a digital format.
- You agree with our Terms of Use and our Privacy Policy.
- You warrant and represent that you have all legal, moral, and other rights that may be necessary to grant us with the license set forth in this Section.
- You agree to grant to us a worldwide, royalty-free, perpetual, non-exclusive right and license (including any moral rights or other necessary rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate, and to create derivative works and compilations, in whole or in part. Such license will apply with respect to any form, media, technology known or later developed.
- You acknowledge and agree that we shall have the right (but not obligation), in our sole discretion, to refuse to publish or to remove or block access to any content you provide at any time and for any reason, with or without notice.
- You shall not impersonate or misrepresent your association with any person or entity, or forge or otherwise seek to conceal or misrepresent the origin of any content provided by you.
- You shall not provide any content that may give rise to our civil or criminal liability or which may constitute or be considered a violation of any local, national or international law, including but not limited to laws relating to copyright, trademark, patent, or trade secrets.
- You agree to release, discharge and hold harmless toNoodle LLP their legal representatives, their affiliates, subsidiaries, suppliers, sponsors, agencies and their respective officers, directors, employees and agents, from any damages which may arise out of participation in the Contest, or out of the acceptance, use, misuse or possession of contest prizes.
- You agree to abide by these Official Rules and the decisions of toNoodle LLP which are final and binding.
- WINNERS VERIFICATION
ToNoodle LLP will send to Winners documentation that must be completed prior to announcing prize winners. Winners will be required to execute and return signed documentation by April 10, 2009 via certified mail to toNoodle LLP, 540 E 500 N, American Fork, UT 84003. - LIMITATION OF LIABILITY
ToNoodle LLP reserves the right in its sole discretion, to cancel, or suspend Contest should virus, bugs or other causes beyond the control of toNoodle LLP interfere in the administration, security or proper participation in Contest. Entrants entering through the Web must provide a valid e-mail address. ToNoodle LLP is not responsible for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in Contest or by any technical or human error which may occur in the processing of the entries in Contest. - PUBLICATION
Acceptance of any prize constitutes permission for toNoodle LLP, its affiliates, subsidiaries, advertising and promotional agencies to use winner’s name, likenesses, and submitted Kits for advertising and promotional purposes without additional compensation unless prohibited by law. Each winner further grants to toNoodle LLP the right to use and publish his or her identity and home city and home state online and in print, or any other media, in connection with this and other Promotions. - EMAIL INFORMATION
